Practice Areas
Why Choose Pendergrass Law Firm, PLLC?
Accordingly, when the client needs a business or real estate transaction closed, the matter is assigned to a transactional lawyer who has little or no practical appreciation for the litigation risks associated with a transaction. Similarly, when business and real estate clients find themselves in litigation, it is typically handled by litigators who have no experience in actually closing a business or real estate transaction. If that litigation ends up in an appellate court, the matter then gets reassigned, yet again, to an appellate attorney who has neither closed a business or real estate transaction nor tried a case.
Our History
Pendergrass Law Firm, PLLC was founded by James K. Pendergrass, Jr., a Board Certified Specialist in Real Property Law, Residential, Business, Commercial and Industrial Transactions. Over the past 28 years, he has closed hundreds of transactions, resolved hundreds of land title issues, repaired dozens of failed condominium regimes in North and South Carolina, and litigated business and real estate disputes in almost all of the state’s 100 counties and in each of the three Federal Court Districts, including the North Carolina Business Court, the North Carolina Court of Appeals, the North Carolina Supreme Court and the 4th Circuit Court of Appeals.
Our Philosophy
We believe that clients get the best representation in a transaction if the risk of potential litigation can be evaluated as part of closing the transaction. We also believe the best possible result can be achieved in litigation [should it arise] if the matter is tried or the appeal handled by a lawyer who understands the intricacies of a transaction as opposed to someone who has been coached on how a transaction works by a colleague down the hall.
We believe that so strongly that each of our attorneys are Board Certified Specialists in Real Property Law-Residential, Business, Commercial and Industrial Transactions. It is a condition of long-term employment in our firm that all of our attorneys take and pass that specialty examination [administered by the North Carolina State Bar Board of Legal Specialization] and maintain that specialty certification.
By contrast, all of our lawyers close transactions and litigate disputes involving transactions. In other words, we understand both sides of the issue.
